These Terms govern only your use of the public Polaris Psychology website, public website forms, and non-clinical SMS communications relating to general inquiries, scheduling, and billing.
These Terms do not govern the provision of psychological, healthcare, or other professional services. Any therapy, psychological evaluation, psychological assessment, telehealth services, billing obligations, informed consent, privacy rights relating to protected health information, or other clinical or professional services are governed by separate intake, consent, privacy, practice policy, and client service documents provided by Polaris Psychology.

The content on this Site, including articles, “resource” posts, educational materials, and service descriptions, is provided for general informational purposes only.
- It is not medical, psychological, mental health, or legal advice.
- It does not create a psychologist-client, therapist-client, or other professional relationship.

Please do not use this Site, its public forms, ordinary email, or ordinary text messaging to send urgent, emergency, highly sensitive, or confidential clinical information. These channels may not be monitored at all times and may not be appropriate for time-sensitive or confidential communications.
Submitting a website form, ordinary email, or text message does not create a psychologist-client relationship, does not guarantee a response by any particular time, and is not an appropriate way to seek crisis support or emergency care.
Your responsibility for what you send
Polaris Psychology provides the notice above so that you can make an informed choice about what to communicate through public forms, ordinary email, or text messaging. If you choose to send urgent, emergency, highly sensitive, or confidential information through any of these channels — including but not limited to crisis-related content, detailed clinical information, sensitive personal or family information, immigration-related details, financial account information, or identification numbers — you do so at your own risk, and you accept the risks inherent in those channels (including but not limited to interception, misdelivery, delayed receipt, lack of secure storage on devices outside Polaris Psychology’s control, and access by others to your phone, email account, or voicemail). You agree that Polaris Psychology is not responsible for the consequences of your choice to use these channels for such communications.
No duty of monitoring or response on these channels.
Polaris Psychology does not commit to monitoring public forms, ordinary email, or text messaging at any particular time, and does not guarantee receipt of, review of, or response to any communication sent through these channels. Polaris Psychology may decline to respond to communications through these channels, may delay response, or may redirect the communication to a more appropriate channel (such as the secure client portal, a scheduled appointment, or a phone call), in its sole discretion and consistent with applicable law and professional standards.
A reply does not constitute consent to the channel.
Polaris Psychology may, in its discretion, respond to communications received through public forms, ordinary email, or text messaging — including for administrative reasons, to acknowledge receipt, to redirect the communication to a more appropriate channel, or to address an immediate safety concern. Any such response by Polaris Psychology does not constitute consent to, endorsement of, ratification of, or agreement to use that channel for clinical, sensitive, confidential, or urgent communications, either for the matter at hand or for any future communications. Polaris Psychology reserves the right at any time to require that clinical, sensitive, confidential, or urgent communications be conducted through a different channel (such as the secure client portal, a scheduled appointment, or a phone call) regardless of any prior communication exchange.

You agree to use this Site only for lawful purposes. You may not:

To the fullest extent permitted by applicable law, Polaris Psychology disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, with respect to the Site, the Site content, public website forms, non-clinical SMS communications, and any information made available through the Site, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, security, availability, and uninterrupted or error-free operation.

Limitation of liability
To the fullest extent permitted by applicable law, Polaris Psychology, its members, clinicians, employees, contractors, agents, and affiliates (collectively, the “Polaris Parties”) will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the public website, public website forms, non-clinical SMS communications, or any informational content made available on the website, regardless of the legal theory of liability and even if a Polaris Party has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the total aggregate liability of the Polaris Parties to you for all claims arising out of or relating to your use of the public website, public website forms, or non-clinical SMS communications, regardless of the cause of action or theory of liability, shall not exceed One Hundred U.S. Dollars (US $100).
This limitation applies only to claims arising from use of the website, public forms, or non-clinical SMS communications. It does not alter any rights or obligations that may arise under separate client service, informed consent, privacy, billing, telehealth, or other professional agreements, and it does not limit any liability that cannot be limited under applicable law (including but not limited to liability for clinical professional services).
Your sole remedy for dissatisfaction with the Site is to stop using it.
Indemnification
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Polaris Parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms
- Your misuse of the public website, public website forms, or non-clinical SMS communications
- Your violation of any applicable law in connection with your use of the website or non-clinical SMS communications
- Your infringement of any intellectual property or other right of any person or entity through your use of the website
- Any information or content you submit through the website or non-clinical SMS communications, including any claim that such information or content is inaccurate, misleading, unlawful, or infringing
This indemnification obligation applies only to claims arising from your use of the website, public website forms, or non-clinical SMS communications. It does not apply to clinical, healthcare, or professional services, which are governed by separate documents and applicable law.
Polaris Psychology reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with Polaris Psychology’s defense of such claim.
Mandatory arbitration and class action waiver
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES BINDING INDIVIDUAL ARBITRATION OF MOST DISPUTES AND LIMITS YOUR ABILITY TO PARTICIPATE IN CLASS OR REPRESENTATIVE PROCEEDINGS. YOU HAVE THE RIGHT TO OPT OUT WITHIN THIRTY (30) DAYS AS DESCRIBED BELOW.
Agreement to arbitrate
You and Polaris Psychology agree that any dispute, claim, or controversy arising out of or relating to (a) these Terms, (b) your use of the public website, (c) your use of public website forms, or (d) non-clinical SMS communications between you and Polaris Psychology (each a “Dispute”) shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except as expressly provided below.
Exceptions to arbitration
Notwithstanding the foregoing, the agreement to arbitrate does not apply to, and the following may be brought in court or before the applicable authority rather than in arbitration:
- Disputes about clinical, healthcare, or other professional services, which are governed by separate documents and applicable law
- Claims that may properly be brought in a small claims court of competent jurisdiction, if the claim qualifies and remains in small claims court
- Claims for injunctive or other equitable relief to protect intellectual property rights or to address unauthorized access to or use of the Site
- Filings with regulatory, licensing, or other governmental bodies, including civil rights and consumer protection agencies and professional licensure boards
- Any other dispute that applicable law prohibits from being subject to a pre-dispute arbitration agreement
Class action waiver
To the fullest extent permitted by applicable law, you and Polaris Psychology agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff, claimant, or class member in any purported class, collective, consolidated, mass, or representative proceeding. The arbitrator may not consolidate the claims of more than one person and may not preside over any form of representative or class proceeding.
If a court of competent jurisdiction finds the class action waiver in this section to be unenforceable as to any specific claim, that claim shall be severed from the arbitration and brought in a court of competent jurisdiction, but the remaining Disputes shall be resolved by arbitration in accordance with this section.
Opt-out right
You may opt out of this arbitration agreement and class action waiver by sending written notice to Polaris Psychology within thirty (30) days after first accepting these Terms. Notice must include your name, contact information, and a clear statement that you wish to opt out of the arbitration agreement, and must be sent to:

Opting out will not affect any other provision of these Terms and will not affect your access to or use of the Site.
Arbitration procedure
Arbitration shall be conducted by a single arbitrator. The arbitration shall take place in New Hampshire or, at your election, by telephone, video, or written submission where reasonably feasible. The arbitrator’s decision shall be final and binding, subject only to limited judicial review as provided by the Federal Arbitration Act and applicable law. Each party shall bear its own attorneys’ fees and costs except as otherwise provided by applicable law or the AAA Consumer Arbitration Rules.
Survival
This arbitration agreement, including the class action waiver, shall survive termination of these Terms.
Severability of arbitration provisions
Except as expressly provided regarding the class action waiver, if any portion of this arbitration agreement is found to be unenforceable, that portion shall be severed and the remainder shall remain in full force and effect.
Governing law and venue
These Terms and any Dispute (as defined above) arising out of or relating to these Terms or your use of the public website, public website forms, or non-clinical SMS communications shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law principles, except to the extent applicable non-waivable law requires otherwise.
For any claim that is not subject to the mandatory arbitration provision above (including claims excluded from arbitration and claims brought after a valid opt-out), or for proceedings to enforce or confirm an arbitration award, the exclusive venue shall be the state or federal courts located in the State of New Hampshire, and you consent to the personal jurisdiction of those courts, except where another forum is required by applicable law.
Force majeure
Polaris Psychology shall not be liable for any failure or delay in performance arising out of or relating to circumstances beyond its reasonable control, including but not limited to natural disasters, severe weather, acts of war or terrorism, civil unrest, public health emergencies or pandemics, governmental orders or actions, labor disputes, power or internet outages, third-party service provider failures, cyberattacks, or other events beyond reasonable control.
Assignment
Polaris Psychology may assign these Terms and any of its rights or obligations under these Terms, in whole or in part, in connection with a sale, merger, reorganization, or transfer of all or substantially all of its business or assets, or otherwise as permitted by law. You may not assign your rights or obligations under these Terms without Polaris Psychology’s prior written consent. Any attempted assignment in violation of this provision is void.
Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms shall remain in full force and effect.
Waiver
No waiver by Polaris Psychology of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Polaris Psychology’s failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.
Entire agreement
These Terms constitute the entire agreement between you and Polaris Psychology with respect to your use of the public website, public website forms, and non-clinical SMS communications, and they supersede any prior or contemporaneous understandings, communications, or agreements relating to that subject matter.
These Terms do not govern the provision of psychological, healthcare, or other professional services, which are governed by separate intake, consent, privacy, billing, practice policy, telehealth, and client service documents provided by Polaris Psychology. In the event of any conflict between these Terms and a separate professional-services document, the professional-services document governs the matters within its scope.
Changes to these terms
Polaris Psychology reserves the right to modify these Terms at any time. Polaris Psychology will post the most current version on this Site and will update the Effective Date at the top of the Terms. Your continued use of the Site after the Effective Date of any change indicates your acceptance of the modified Terms.
Material changes to the Mandatory Arbitration and Class Action Waiver section will not apply retroactively to Disputes that arose prior to the effective date of the change.

Polaris Psychology may send and receive two-way text messages with you relating to general inquiries, appointment requests, scheduling, reminders, and related administrative communications. Polaris Psychology does not use SMS for marketing campaigns or bulk promotional text messaging. Message frequency varies depending on your interaction with Polaris Psychology.

Opt-Out
